Munich – Prof. Dr. Caspar Behme (37 years old) joins Walberg Law Tax Strategy GmbH & Cie. KG („Walberg & Cie.“) as Of Counsel. He will support Walberg & Cie. as Of Counsel from December 2023, primarily in the areas of M&A and corporate law in particularly complex legal matters, as well as in insolvency and capital markets law. Behme will also support Walberg & Cie. in contentious disputes before state courts and arbitration tribunals. In the future, he will also play an important role at Walberg & Cie. in the area of digitalization and the associated knowledge management.
Behme has been a professor of civil law, in particular contract law and contract drafting, with a research focus on corporate law at the Frankfurt University of Applied Sciences since April 2023. He was habilitated in July 2021 at the Law Faculty of the Ludwig Maximilian University of Munich. He was awarded the teaching qualification for the subjects of civil law, commercial law, German, European and international corporate law and capital market law. Behme has extensive practical legal experience, particularly in the out-of-court settlement of commercial disputes, both as an arbitrator and as a certified commercial mediator, and also as a party representative before the European Court of Justice. He maintains a lively publication activity and has built up a comprehensive commercial law oeuvre. In addition to numerous articles in specialist journals and commentaries, including in the Munich Commentary on the German Stock Corporation Act, the Munich Commentary on the Insolvency Code, the Munich Handbook of Corporate Law and other commentaries and handbooks on restructuring law, investment law and the law of general terms and conditions, he is co-editor of the LRZ – E-Zeitschrift für Wirtschaftsrecht und Digitalisierung and a leading commentary on investment law. His publications highlight issues in the areas of contract law, M&A, German and European corporate and insolvency law as well as investment law and crypto assets.
„With Caspar Behme, we are gaining a brilliant lawyer who can provide even the most complex legal issues with extremely fast, to the point and clearly robust practical solutions. He will help us with complex transactions in particular. He understands how to bridge the gap between academia and practice exceptionally well and is an excellent team player,“ says Dr. Simon Sabel, lawyer and co-founder of Walberg & Cie. „We also benefit from Caspar Behme’s in-depth expertise in corporate law and reorganization law, particularly in the area of tax advice – this enables us to provide even more holistic tax and legal advice on restructurings,“ adds Manuel Brühl, tax advisor and co-founder of Walberg & Cie. „The fact that Caspar Behme gave his post-doctoral lecture on the topic of ‚Liability for autonomous systems and artificial intelligence‘ impressively demonstrates the synergies between Mr. Behme’s expertise and our advisory focus areas,“ notes Dr. Arno Malcher, lawyer and co-founder of Walberg & Cie.
„As an academic, I have never defined myself by differentiating myself from practice; on the contrary, I have endeavored to facilitate the practical application of the law through application-oriented research. I am very pleased to be able to contribute to the success of complex transactions through my academic approach and to be able to solve challenging legal issues in the context of contentious disputes; at the same time, I hope that my work at Walberg & Cie. will provide impetus for my research,“ says Prof. Dr. Caspar Behme.
The founders of Walberg & Cie. and Behme have known each other personally for some time and have repeatedly worked together on individual projects in the past. The integration as Of Counsel is now the next logical step. „Caspar Behme is a perfect match for us and we are delighted to be working with him to further develop Walberg & Cie. into an outstanding address for complex commercial and tax law projects,“ say the founders Brühl, Malcher and Sabel.
